1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Enertime Sdn. Bhd. (“we”, “us”, or “our”), concerning your access to and use of the website https://enertime.com.my as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site or purchasing products from us, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws of Malaysia and international jurisdictions.

Specifically, the Enertime brand name, logos, plant-based supplement formulations, and patented ingredient references (such as CarnoSyn® Beta-Alanine) are our exclusive intellectual property or used under license. No part of the Site, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.

3. User Accounts & Registrations

To purchase products or access specific features (such as the Enertime distributor dashboard), you may be required to register an account with us. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Promptly notify us if you discover or otherwise suspect any security breaches related to the Site or your account.

We reserve the right to suspend or terminate your account if any information provided is untrue, inaccurate, outdated, or incomplete, or if you violate our code of conduct as a distributor or customer.

4. Products & E-Commerce Sales

We make every effort to display as accurately as possible the colors, features, specifications, and details of our products (including plant-based proteins and supplements) available on the Site. However, we do not guarantee that the product details, packaging colors, or ingredients are always completely up-to-date or free of typographical errors.

• Pricing: All prices displayed on the Site are in Ringgit Malaysia (RM) and are subject to change at any time without notice. Member and distributor pricing is subject to specific role verifications.
• Payments: All payments are securely processed and encrypted via our gateway partner, senangPay. By submitting payment details, you authorize us to charge the applicable amount to your card or FPX bank account.
• Order Acceptance: We reserve the right to refuse or cancel any order placed on the Site at our sole discretion, including limiting quantities purchased per person or per order.

5. Shipping & Delivery

All shipping and delivery arrangements are governed by our Shipping Policy:

• Logistics Provider: Domestic shipments are handled securely by **Ninja Van**.
• Timelines & Risks: Delivery timelines (typically 1–3 working days for Peninsular Malaysia, and 3–5 working days for East Malaysia) are estimates. We are not responsible for delays caused by the courier. Risk of loss and title for items pass to you upon our delivery of the items to Ninja Van.

6. Returns & Refunds

Your purchases are subject to our Return Policy. Due to strict health, hygiene, and food safety regulations governing nutritional consumables, we can only accept returns of products that are completely unopened, unused, and with original safety seals intact. 7. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activity includes:

• Systematically retrieving data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory.
• Circumventing, disabling, or otherwise interfering with security-related features of the Site.
• Engaging in unauthorized framing of or linking to the Site.
• Interfering with, disrupting, or creating an undue burden on the Site or the networks or services connected to the Site.

8. Limitation of Liability

In no event will Enertime Sdn. Bhd., our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or our products, even if we have been advised of the possibility of such damages.

9. Governing Law

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. Any legal action or dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
